Anexo al Contrato de alquiler y servicio: Términos del Plan de protección de alquiler

El plan de protección de alquiler (“RPP”) es un producto opcional descrito en este anexo (el “Anexo”) que modifica ciertos términos del Contrato de alquiler y servicio celebrado entre United y el Cliente. The definitions set forth in Section 1 of the Rental and Service Terms incorporated into the Rental and Service Agreement apply to this Addendum.

FOR ALL RENTALS OF EQUIPMENT YOU MUST EITHER SHOW PROOF OF PROPERTY INSURANCE IN ACCORDANCE WITH SECTION 23 OF THE RENTAL AND SERVICE TERMS, OR PURCHASE THE RENTAL PROTECTION PLAN. THE PURCHASE OF THE RENTAL PROTECTION PLAN FOR RENTALS OF EQUIPMENT IS NOT MANDATORY AND MAY BE DECLINED IF YOU HAVE PROOF OF INSURANCE AS REQUIRED BY SECTION 23 OF THE RENTAL AND SERVICE TERMS.

POR UN CARGO ADICIONAL, EL PLAN DE PROTECCIÓN DE ALQUILER LE OFRECE UNA EXENCIÓN DE RESPONSABILIDAD POR DAÑOS PARA LIMITAR SU RESPONSABILIDAD FINANCIERA EN EL CASO DE DAÑOS O ROBO DEL EQUIPO DE ALQUILER. ANTES DE DECIDIR SI ADQUIRIRÁ LA EXENCIÓN DE RESPONSABILIDAD POR DAÑOS. PUEDE DETERMINAR SI SU PROPIO SEGURO LE BRINDA COBERTURA POR DAÑOS O ROBO DEL EQUIPO, ASÍ COMO EL MONTO DEL DEDUCIBLE CONFORME A SU COBERTURA DE SEGURO. LEA ESTE ANEXO CON ATENCIÓN ANTES DE FIRMAR.
TÉRMINOS Y CONDICIONES
In return for payment of the fee set forth in the Rental and Service Agreement, United agrees to limit its rights under Sections 11 and 23 thereof as follows:
Excepto para los alquileres de Vehículos de pasajeros y sujeto a las condiciones especificadas en este documento, United renuncia a su derecho de cobrarle al Cliente importes que excedan el 10% del valor de reemplazo del Equipo, el 10% del costo de las reparaciones o $500.00 más los impuestos estatales y locales (lo que sea menor) por pérdidas que sean consecuencia del robo o el daño físico directo del Equipo.
Para los alquileres de Vehículos de pasajeros, el Cliente seguirá siendo responsable de todos los costos y cargos después de los primeros $7,500.00 por período de alquiler, por pérdidas que surjan del robo o daño físico directo al Vehículo de pasajeros. United renuncia a su derecho de cobrar $500.00 al cliente si las pérdidas que surjan del robo o daño físico directo al Vehículo de pasajeros superan los $7,500.00 por período de alquiler.
El Cliente conviene en que el Cliente, o usuario permitido por el Cliente, será el único conductor de cualquier vehículo de United, y que el Cliente no usará el vehículo de modo que infrinja la ley o alguno de los términos y condiciones del Contrato de alquiler y servicio.
United no renunciará a un reclamo por pérdida o daño de neumáticos o cámaras causado por reventones, golpes, cortes, perforaciones u otras causas inherentes al uso del Equipo, o que resulten del uso indebido intencional del Equipo. Estas pérdidas seguirán sujetas a lo dispuesto en la Sección 11 del Contrato de alquiler y servicio.
Except for Passenger Vehicle rentals and subject to the conditions set forth herein, Customer shall pay a fee equal to 15% of the rental charges under the Rental and Service Agreement, plus applicable state and local taxes, in exchange for participation in the RPP as set forth in this Addendum.
For Passenger Vehicle rentals, Customer shall pay a fee equal to 25% of the rental charges under the Rental and Service Agreement, plus applicable state and local taxes, in exchange for participation in the RPP as set forth in this Addendum.
Con respecto a un Vehículo alquilado por 60 días o menos y que esté sujeto al RPP, no se aplicará la Sección C (exclusión de neumáticos) de este Anexo.
Con respecto al alquiler de un Vehículo, el RPP es un descargo de la responsabilidad del arrendatario de devolver el Vehículo en las mismas condiciones que tenía al alquilarse, y no se aplicará la Sección C (exclusión de neumáticos) de este Anexo.
“Agreement” means the Reservation Details (as defined below), together with the RPP and any associated Rental and Service Agreement (as defined below), including these Rental and Service Terms which are incorporated by reference therein.
“United ” se refiere a United Rentals (Norteamérica), Inc.
“Equipment” means any one or more of the items identified as rental items in the Reservation Details and any accessories, attachments or other similar items delivered to Customer including, but not limited to any items rented in association with the Services identified in Section 25 below, air hoses, electric cords, blades, welding cables, liquid fuel tanks and nozzles.
“Cliente” significa la persona o entidad identificada como tal en los Detalles de la reserva, o cualquier representante, agente, funcionario o empleado del Cliente.
“Store Location” means the United address set forth in the Rental and Service Agreement.
“Operador calificado ” hace referencia a cualquier persona autorizada por el Cliente para manejar el Vehículo dentro de los Estados Unidos. Este término incluye a las personas identificadas como Operadores calificados adicionales en el Contrato de alquiler y servicio. Todos los Operadores calificados deben tener un permiso de conducir válido en inglés o un IDP (Permiso de conducir internacional) en el caso de clientes que tengan un permiso válido que no esté en inglés, además de la experiencia y capacitación necesarias para manejar los Vehículos o Equipos. Al manejar el Vehículo, el Operador calificado se considerará mancomunada y solidariamente responsable de las obligaciones del Cliente relacionadas con el Vehículo y de cualquier obligación que el Contrato de alquiler y servicio imponga al Operador calificado del Vehículo.
“Contrato de alquiler y servicio” se refiere al contrato celebrado entre el Cliente y United para que United alquile Equipos y/o preste Servicios, sin importar si dicho Contrato se celebra en persona en la ubicación de la tienda, por internet, o en el momento de la entrega de los Equipos, y que incorpora por referencia estos Términos de alquiler y servicio e identifica los Equipos que alquilará el Cliente. El Contrato incorpora estos Términos de alquiler y servicio por su referencia.
“Rental Period” means the period of time between the “Rental Out” and “Scheduled In,” set forth in the Rental and Service Agreement, except that the Rental Period may terminate earlier as provided in Sections 22 and 30 hereof or if Customer returns the Equipment earlier. “Tarjeta de crédito” significa la tarjeta de crédito proporcionada por el Cliente como parte de este Contrato o que, de otro modo, se mantiene en los archivos de United.
“Detalles de la reserva” se refiere a los Equipos, el Período de alquiler, la información de entrega, la información de pago y cualquier otra información que se indique en la Pantalla de resumen de la orden/confirmación o en el Contrato de alquiler y servicio, según corresponda.
“Service” or “Services” means the delivery, pick up and repair of Equipment and other services provided by United in connection with the rental of Equipment, including Trench Services, Scaffolding Services, Portable Sanitation Services, Fluid Solutions Services, Power and HVAC Services and Tool Services (each as defined in Section 25 below).
“Specialty Media” means specialty filtration materials purchased in connection with the rental of Equipment used for fluid solutions, such as sand, gravel, carbon, or other materials used to remove certain contaminants or other materials.
“Tanks” means the Equipment identified as rental items as part of the Fluid Solutions Services in which Customer stores materials.
“Vehicle” means a motor vehicle or EV (as defined below) or Passenger Vehicle (as defined below) identified as the rental item(s) in a Rental and Service Agreement, reservation detail, or similar document; “EV” means a battery-powered motor vehicle with a non-combustion engine that is identified as an EV or electric vehicle rental item(s) in a Rental and Service Agreement, reservation detail, or similar document; “Passenger Vehicle” means pickup trucks, passenger vans, cargo vans, SUVs and automobiles with a manufacturer’s gross vehicle weight under 11,000 lbs; and “Vehicles” collectively refers to each such Vehicle. “Non-Hazardous Waste” means any material, substance or waste that does not fall under the definition of “Regulated Materials” defined in Section 8(A).
